(a) In the event the City Attorney is not available to perform the duties of the office for five (5) or more days because of illness, incapacity, annual leave, official leave for City business, or any other reason, the City Attorney may appoint an Acting City Attorney to perform the duties of the City Attorney during such absence, incapacity, or unavailability.

(b) In the event of a vacancy in the office of City Attorney, the City Manager may appoint an acting City Attorney, which appointment shall be subject to confirmation by a City Council vote in the manner provided for ordinances.

(c) Any person appointed Acting City Attorney under these provisions shall be a member in good standing of the Alaska Bar Association and duly licensed to practice law in Alaska.

(d) The appointment of an Acting City Attorney shall be made in writing and copies of the appointment shall be distributed to all Council Members, Department Heads, and Commission Chairpersons, and a copy thereof shall be placed in the personnel file of the employee so appointed.

(e) When any period of service as Acting City Attorney shall be five (5) working days or more in length by a Legal Assistant, the person so serving shall be paid at the highest step in the Legal Assistant pay range as provided in KMC 23.55.010 during such period or in the case of a vacancy of the City Attorney position at a rate set by the City Council. No additional compensation shall be paid to a Deputy City Attorney serving as Acting City Attorney.
