(a) An impounded animal that is the subject of a hearing or appeal pursuant to KMC 3.25.080 or criminal proceedings before a court of competent jurisdiction shall be held in the Animal Control Shelter pending a final decision and any appeals from that decision.

(b) An animal other than one described in subsection (a) of this section that is not subject to redemption, and for any of the reasons stated in KMC 3.25.050(b)(1) through (3) is not being held for adoption, may be disposed of in a humane manner.
